
Material Participation Tests
The passive activity loss rules under IRC Section 469 limit the ability to offset passive losses against active or portfolio income. Material participation is the key determinant of whether an activity is passive or non-passive.
The Seven Tests
A taxpayer materially participates in an activity if they satisfy any one of the following seven tests:
500-Hour Test:Participation of more than 500 hours during the tax year
Substantially All Test:The taxpayer's participation constitutes substantially all participation in the activity
100-Hour/No Greater Test:More than 100 hours of participation, and no other individual participates more
Significant Participation Activity:Aggregate participation in all significant participation activities exceeds 500 hours
Prior Year Test:Material participation in any 5 of the preceding 10 tax years
Personal Service Activity Test:Material participation in any 3 preceding years for personal service activities
Facts and Circumstances Test:Regular, continuous, and substantial participation based on all facts
